The ADA wants the companies to make available all patient-level data on their products for an independent review “that could help settle the question of whether such therapies contribute to the development of pancreatitis or pancreatic cancer,” the organization said in a statement.

“People who are taking these medications, or who may consider taking them, should have the benefit of all that is currently known about their risks and advantages in order to make the best possible decisions about their treatment and care in consultation with their healthcare providers,” Robert Ratner, MD, chief scientific and medical officer of the ADA, said in a statement.

The European Medicines Agency’s investigation comes on the heels of a similar probe by the U.S. FDA.

An academic research article published in the Diabetes journal has regulators concerned. The article suggests that an entire class of type 2 diabetes drugs called incretin mimetics may lead to an increased risk of pancreatic cancer. Earlier studies indicate a link between these drugs and thyroid cancer.

Incretin mimetic drugs include several widely popular medications, such as Byetta, Bydureon, Januvia, Janumet, and Victoza.

The Januvia and Byetta attorneys at Upton Law Firm believe there is evidence indicating that the manufacturers of these drugs knew of the cancer risk but failed to warn patients. If you or a loved one were injured by Januvia, Byetta, or another incretin mimetic, you may be entitled to compensation through a diabetes drug lawsuit. To begin your free legal consultation, call 1-877-675-7987 or complete the form available here.

In April, the FDA said it is evaluating Januvia and other drugs in the incretin mimetics class for possible links to cancer.

Dr. Peter C. Butler, chief of the division of endocrinology at the University of California Los Angeles, conducted the scientific research at the heart of the FDA’s Januvia warning.

The future of Januvia and other similar drugs, including Byetta, Bydureon, Victoza, and Janumet, is now in doubt.

The National Institutes of Health will review the possible links between diabetes drugs and pancreatic cancer later this month.

The product liability attorneys at Upton Law Firm are investigating possible Januvia cancer lawsuits as well as Byetta, Bydureon, Victoza, and Janumet lawsuits. Bard Inc. pelvic repair system multidistrict litigation has denied the defendant’s motion to dismiss punitive damages claims brought in four bellwether cases.

U.S. District Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia found that the plaintiffs had established a question of fact as to whether the company’s actions rose to a level amounting to culpable behavior.

The judge concluded, “the mere inclusion of some warning with a product does not absolve the manufacturer of potential punitive damage liability . . ..”

Elizabeth Childress, who is only 23 years old, said in the complaint that she was diagnosed with thyroid cancer after using Byetta to treat diabetes.

Childress seeks damages from Amylin and Eli Lilly for failure to warn, defective design, negligence, breach of warranty, negligent misrepresentation, and fraudulent concealment. Byetta has also been the subject of a number of pancreatic cancer lawsuits in recent months.

Byetta is an incretin mimetic diabetes drug. This class of medications also includes Januvia, Victoza, and a longer-acting version of Byetta known as Bydureon.

Last month, attorneys for various plaintiffs asked that all Effexor birth defect cases in the federal court system be consolidated before one judge for pretrial proceedings.

This type of consolidation is referred to as Multidistrict Litigation or MDL.

Defense lawyers for the manufacturer of Effexor, Pfizer, recently filed a motion supporting an MDL for cases brought on behalf of children who suffered birth defects or malformations after their mothers used the antidepressant during pregnancy.

Both sides agree that the new MDL should be assigned to the judge who is handling all Zoloft birth defect lawsuits against Pfizer, which is another of the company’s antidepressants similar to Effexor.

The establishment of an MDL is common in complex litigation where a large number of complaints have been filed throughout the country involving similar allegations.

There are currently at least 14 cases pending in 7 different U.S. District Courts that allege Pfizer did not adequately warn about the effects that Effexor may have on unborn children. Given the widespread use of Effexor, hundreds of additional lawsuits are likely.

Oral arguments on the motion to centralize the Effexor birth defect lawsuits are scheduled for July 25, 2013 in Portland, Maine.
