<p>This announcement is not surprising given the high early failure rates in these devices and the numerous lawsuits the company is now facing.</p>
<p>In 2010, DePuy recalled an all-metal hip model known as the Articular Surface Replacement, or A.S.R., because it was failing just a few years after implant. Typically, artificial hips should last 15 years or more before they wear out. The company has continued to sell an all-metal hip called Pinnacle.</p>
<p>It is estimated that metal-on-metal replacement hips—products in which both the cup and ball are metal—once accounted for about one in three hip implants in the United States.</p>
<p>Unfortunately, patients quickly learned that the metal components in these products rubbed against each other as they moved, creating tiny particles that could damage tissue, muscle, and bone.</p>
<p>Johnson &amp; Johnson is now facing over 10,000 cases related to the A.S.R. and 3,300 cases related to the Pinnacle, according to a company filing with the Securities and Exchange Commission.</p>

Vitas is the largest for-profit hospice chain in the U.S.</p>
<p>The government’s complaint alleges that Chemed and Vitas Hospice submitted false claims to Medicare for crisis care services that were not necessary, not actually provided, or not performed in accordance with Medicare requirements. According to the complaint, the companies set goals for the number of crisis care days that were to be billed to Medicare. The companies also allegedly used aggressive marketing tactics and pressured staff to increase the numbers of crisis care claims submitted to Medicare, without regard to whether the services were appropriate or were actually being provided.</p>
<p>In addition, the government’s complaint alleges that Chemed and Vitas submitted false claims for hospice care for patients who were not terminally ill. The companies allegedly paid bonuses to staff based on the number of patients enrolled in the program and based on patients who were admitted for longer lengths of stay, and took adverse employment actions against marketing representatives who did not meet monthly hospice admissions goals.</p>
<p>The government contends that Chemed and Vitas violated the False Claims Act and misspent tens of millions of taxpayer dollars from the Medicare program.</p>
<p>Ordinary citizens who know of fraud against the government can also take action.  The “qui tam” provision of the False Claims Act allows a person to act as whistleblowers and sue the wrongdoer on behalf of the U.S. government. Any person or entity that has evidence of a fraud occurring against the government may act as a whistleblower under the False Claims Act. A successful whistleblower is entitled to a percentage (ranging from 15-30%) of the total amount of monies the government recovers from the lawsuit.</p>

<p>Incredibly, some of the unnecessary testing was deemed to be potentially life threatening and was performed by unlicensed or untrained personnel.</p>
<p>According to the U.S. Attorney for the District of New Jersey, “Katz was so focused on illegal profits that he directed unlicensed and unqualified providers to treat his patients, ordered unnecessary tests, and cavalierly ordered treatments that could have caused patient harm. Ripping off the government and insurance companies is bad enough; risking patient health in the bargain is inexcusable.”</p>
